| Fresno Pit-Bull Dog Attack and Dog Bite |

A 13-year-old boy suffered serious injuries when a 70 pound pit-bull dog attacked him causing serious injuries from the resulting pit bull dog bites. The thirteen-year-old boy's aunt had been drinking alcohol and thought it would be hilarious for her pit-bull to attack her nephew. The boy was transported to the hospital with serious dog bite injuries, and the aunt was charged and arrested with child endangerment.
The young boy had severe bleeding coming from his arm as a result of this pit-bull dog attack. The young boy was transported to a Turlock hospital. The suspect admitted that this was not the first time that her pit-bull attacked, but this was the worst attack thus far. The pit-bull is under quarantine after being surrendered to animal control and will be evaulated after 10 days. As this pit-bull dog has attacked and been involved in biting others, and it is determined to be a risk to public safety, the pitbull will be euthanized.

The National Highway Trafic Safety Administration has estimated that over 7,500 lives have been saved through the use of child restrains and child-seats over the last 20 years.
California law reqiures children under 6 and / or weigh less 60 pounds (lbs.) are required to ride in a child-seat or in a child booster-seat. While California has this requirement, some parents may not know the proper way to safely secure their child in the unlikely event they are involved in a car accident with either a motorcycle, truck, big-rig, or tractor-trailer semi-truck.
The California Highway Patrol has elected to hold a workshop to teach parents how to properly secure their child in a car-seat or booster-seat. This workshop is aimed at parents and care-givers who may be transporting children in car-seats or booster-seats. One of the major goals of this workshop program is to educate parents and care-givers about the necessity of car-seats and how car-seats can reduce the severe injuries which could ultimately be sustained by young children who are invovled in an auto accident.
The California Highway Patrol is also hoping to be able to examine currently owned car-seats to make sure that they are properly secured and they do not contain any product defects. While this workshop program is not an intensive program, parents and care-givers must also take the responsiblity to routinely examine their child's car-seats to make sure that they are always securly fastened and all of the restraints are working properly. Waiting until an auto accident occurs is the last time you want to check to make sure that this safetly equipment is working properly.

| 10 year old girl died from blunt force trauma after being involved in a motorcycle accident |

On January 18, 2009, in Ada County, Illiniois, a ten year old girl died from blunt force trauma injuries when a fourteen year old boy driving a motorcycle struck the young girl from behind. Upon the motorcycle colliding with the girl's bicycle, the motorycle accident caused the young girl to be thrown from her bicycle. From the collision of the motorcycle as well as contact with the pavement, the young girl sustained blunt force trauma injuries as well as other serious injuries. While the young girl sustained brain injuries as a direct result of the motorycle accident, there is no indication that she was wearing a helmet.
The young girl's death was reported within four hours of the motorcycle accident, where the young girl was transported to St. Luke's Regional Medical Center Pediatric Intensive Care Unit.
Initially, the motorcycle accident and resulting fatality has been ruled as an accident, but the family of the young girl may still have rights against the young boy's family for their loss. It is essential that they contact an attorney immediately so witnesses and data may be collected while such facts are fresh beyond the investigation being conducted by the Elmore County Sheriff's Office.

| The most fatalities in California in 2007 resulted with passenger cars |

In California in 2007, 41% of the fatalities involved drivers of passenger cars resulting in 1,618 fatalities. The next category of vehicles which had the most fatalities were SUV or light utility trucks. In California in 2007, there were 419 fatalities (11%) of the total fatalities for the year. With the popularity and fuel efficiency of cars as the most affordable, along with the popularity of SUVs, it is easy to see why these two categories of vehicles were involved in the majority of car accidents - as there are more of them on the road than any other type of vehicle.
Further, some drivers were under the impression that they didn't need to wear seat belts while driving SUVs as they were "safer" in an SUV than in a smaller car. These statistics clearly indicate that SUVs did get into a substantial amount of car accidents in California. One potential reason for these numbers could be that the drivers of SUVs may have been driving negligently or without seat belts which could have resulted in more serious injuries, including fatal brain damage or brain injury.

| Fresno County Drunk Driver Crashes Killing Passenger |

On Sunday March 15, 2009, in Fresno, California a negligent driver killed his passenger by causing a fatal car crash. This automobile accident happened around 10 a.m. Sunday morning, near Newmark and American Avenue in Fresno. The crash only involved one car, but there were two passengers in that car. The negligent driver was under the influence of alcohol and lost control of his car.
The California Highway Patrol (CHP) said that the car accident was a complete disaster and that they had to use the Jaws of Life to get the motor vehicle driver and his passenger out of the automobile. The drunk driver suffered minor injuries and was taken to a local hospital in Fresno County. The passenger however, was pronounced dead at the scene of the car crash.
The negligent driver is now facing D.U.I. charges and quite possibly vehicular manslaughter. As the result of his negligence his passenger was killed in a car accident. | California Residents Killed in Plane Crash |

How many of us travel from Fresno to Mammoth to go skiing for pleasure? How many of us leave our home in Fresno, California to board planes for our travels of leisure and pleasure and assume that the safety regulations have been followed. We assume and expect that the conduct of the pilot and those associated with the airport and flights have our best interest at heart. No one in Fresno ever expects a plane to crash, or that they would lose a loved one in a plane accident.
But on Sunday, March 22, 2009 several families lost their loved ones in just this kind of accident, a plane crashed. Among the 14 people who died in the airplane crash in Butte, Montana, at least nine of the passengers were California Residents traveling to Bozeman, Montana in hopes of having a family skiing vacation. The death toll includes a family of four, and a family of five; both with small children. Just a simple family ski trip turned into the wrongful death of 13 people.
Why did this happen? The plane requested to land at a nearby airport and upon confirmation changed course in the midst of flight. It was reported that the pilot did not sound concerned or alarmed, and never reported that he was having trouble with the aircraft. The head of the company that owns the plane did not even have any idea as to who was flying the plane on that flight. Clearly something happened here that was more than just a random occurrence; something should and could have been done to prevent this crash.

| Highway 99 Fog Alert System |

In response to previous traffic accidents which resulted on Highway 99 in Fresno, California, Caltrans has developed a $12 Million Dollar Fog Warning System. Apparently, the system monitors the speed of drivers on Hwy. 99 and can detect if there is fog 30 seconds ahead of the speeding driver. The system will then warn drivers to reduce speed before entering fog banks.
This fog warning system along Highway 99 is supposed to be one of the most technologically advanced fog warning systems in the United States. This $12 Million dollar warning system uses cameras and weather sensors to identify and report on the various displays. This fog reporting system is unique in that it is the first automated fog system.
The benefit of this multi-million dollar automated fog reporting system is yet to be determined, especially where drivers are only told of approaching fog. Hopefully this system could also report as to fogs located ahead, where drivers would be prepared to stop, not just slow down. Also, it is further to be determined whether the fog reporting signs are visible to those drivers who are driving in thick fog on Hwy. 99.

| Chatsworth Metrolink Train Accident Safety Violations |

Last September there was a major Metrolink Train Accident in Chatsworth, California. Upon the release of the trial court transcripts, the presence of various safety violations were identified. Specifically, the metrolink engineer was making calls and sending and receiving texts just prior to the metrolink accident in violation of prescribed safety rules and regulations.
Apparently the Metrolink engineer received and sent a total of 43 text messages while on duty and operating the Metrolink which was a blatant violation of the safety rules and regulations designed for train safety.
Previous text messages indicate that the Metrolink engineer permitted non-Metrolink personnel to sit at the controls of the Metrolink while the Metrolink was in operation, which is also in violation of train safety rules and regulations.
Further, the investigation concluded that all signals and safety equipment were operational, where responsibility for the death of the twenty-four people killed in the Chatsworth, California Metrolink Train Accident resulted from the negligent operation of the train.

| Fatal Bicycle Accident in Fresno, California |

In late February, a fatal bicycle accident on Blackstone Avenue caused the Fresno Police Department to close a segment of the road. The intersection of the bicycle accident occurred at Blackstone and McKinley around 9:00 p.m.
The bicycle rider was attempting to cross Blackstone Avenue, which is a busy road. The investigation reported that the driver of a motor vehicle was traveling in a northernly direction when the bicyclist was struck.
The bicyclist was reported dead at the scene of the bicyle accident / car accident. At the time this accident was reported, the police investigators did not belive that eithe speed or alcohol were factors in the bicycle / pedestrian accident.

| Train Collides With Passenger Motor Vehicle |

The California Highway Patrol reported that a motor vehicle and a train collided around 5:00 a.m. at a railroad crossing at Florin Road which is near 29th Street. The train conductor was conducting a freight train with no passengers. The driver of the motor vehicle sustained moderate to severe injuries and was transported to UC Davis Medical Center in Sacramento hospital for his non life-threatening injuries. Upon the freigh train hitting the passenger automobile, the car caught on fire, where the car subsequently hit the railroad crossing arm which subsequently created a traffic backup.
Investigators at the scene of the train accident were attempting to determine whether any train safety equipment malfunctioned which could have resulted in this train / car accident. As yet, neither alcohol nor speeding appear to be factors in this non-fatal accident.

| Fresno Highway 99 Car Accidents |

Recently, on California Highway 99, due to dense fog, a total of 53 vehicles were involved in a multi-motor-vehicle car accident pile-up. Of the fifty-three vehicles involved, fourty-nine of them were cars, and four of them were tractor trailer big rigs.
At the time of these major accidents, the fog limited vision to about 200 feet. For vehicles traveling at 65 mph, they are traveling at about 100 feet/second. Therefore, these vehicles would only have about two seconds to respond to seeing an accident occur in front of them. However, human reaction time is about 3/4 of a second to move your foot from the gas pedal to the break pedal. Therefore, the drivers involved in this major pile up only had about 1.25 seconds to bring their vehicle to complete a stop. For those cars, trucks, and semi tractor trailers that stopped in time, most of them were still rear-ended by the cars and semi tractor trailers behind them that were unable to stop in time.
Highway 99 has many accidents on it every year, especially in times where road conditions warrant drivers to be traveling at speeds slower than the posted speed limit. Be sure to always leave enough room ahead of you, with a minimum of three-seconds (3 secs.), but feel free to travel slower and with your low-beam headlights on when traveling in fog to further assist with your vision, even if the sun is out.

The insurance industry expects that an increasing number of drivers, for various reasons including the economy, will be driving on the road without insurance. 6. Review and Update Your Insurance Policies
As your vehicle depreciates in value, you may begin to lower your collision coverage. Your initial insurance payments were on the full market value of the vehicle you were driving, and the insurance company is not going to inform you that your vehicle is now worth less, as they always want to recover the maximum from you. | Fresno Police Officer Arrested Again |

In California, it is a misdemeanor to be driving under the influence, and not a felony, until after the fourth conviction and / or an accident occurs where someone is injured to any degree.
A Fresno Police Officer received his first DUI in 1999, his second nine-months later in 2000, a third in 2003 and a fourth in 2007. Fellow DUI Officers, and Mothers Against Drunk Driving, would like to see a first DUI offense to carry harsher sentences than a misdemeanor as people have been seriously injured and even killed as a result of people drinking. This occurs for those drunk drivers who are nowhere near the California legal indicator of .08 BAC or B.A.C. who are still driving while intoxicated.
After receiving an anonymous tip as to this Fresno Police Officer, fellow Fresno police officers attempted to pull him over, but the Fresno Police Officer fled and headed south on Maroa at an estimated 70-80 miles an hour where there was a failure-to-stop at stop-signs and red stop-lights. The Fresno Police Officers eventually ended the high-speed pursuit as they didn't want anyone to be injured or hurt. The Fresno Police Officer was eventually located through GPS of his cell phone.

| Fatal Car Accident Victim Identified |

On January 29, 2009, the Madera County Sheriff identified the fatal two-car accident victim which occurred on Highway 59 near the Highway 152 overpass.
The identified victim was Aldo Christian Hernandez-Torres who was only eighteen (18) years-old. The fatal car accident investigation has indicated that his car crossed over the center line from his southbound lane on Highway 59 and caused a collision with an oncoming car. This car accident occurred when both drivers were on their way to work just before 6:00 a.m.
The other driver, Jose R. A. Garcia, 25, was seriously injured at the scene of the car accident. He was then transported to Doctors Medical Center in Modesto, California. As of January 29, 2009, Mr. Garcia was reported to be in critical condition.
The initial reports indicate that alcohol was not a factor in the accident, but the fatal car accident is still under investigation.
While it is still unclear as to all of the factors that created this fatal car accident, some possible factors may have been a product defect which caused Mr. Hernandez-Torres's car to cross over into oncoming traffic, a pharmacy error, or possibly a medication error. | Fresno Free Ride after Super Bowl to Reduce Auto Accidents |

In Northern California, including Fresno County, free rides are being offered to those individuals who were drinking during the 2009 Steelers vs. Cardinals Super Bowl 2009.
During the 2008 Super Bowl, the California Highway Patrol reported that in California alone, twelve (12) people were killed in alcohol related motor vehicle accidents. This number of fatalities is three times above California's State average. In addition to these twelve motor vehicle fatalities, there were also one-hundred sixy-seven alcohol related motor vehicle accidents. The California Highway Patrol also reported that four-hundred and 3 people were arrested for drunk driving.
For those individuals who were arrested for a first time DUI conviction in California, an individual may have to spend up to $12,000 in fines, penalties, restitution, legal fees, and added insurance expenses.
To help combat this, the American Automobile Association (AAA) offers a free ride home after the Super Bowl for both you and your vehicle. The AAA is extending this offer to individuals who aren't AAA members, to reduce fatalities, injuries, and pain and suffering this Super Bowl weekend.

| Woman charged in death of 2006 Harley Davidson motorcycle rider |

A young woman violated Florida's traffic laws by illegally turning her 2003 Dodge truck in front of the rider, 48, of a 2006 Harley Davidson. The motorcycle rider was riding north on State Road 85 in Crestview, Florida when the car driver, who caused the accident, attempted to turn onto Little Silver Road. Due to the close proximity of the two vehicles at the time of the car's turn, the motorcycle rider was unable to either lay the vehicle down or swerve out of the way of the Dodge truck and instead struck the right side of the truck.
Witnesses of the accident performed CPR on the motorcycle rider until an ambulence arrived to the scene of the motorycle and car accident. The Harley rider was emergency evacuated to North Okaloosa Medical Center, where he ultimately was prounounced dead.
The Harley rider is survived by a wife, daughter and granddaughter.

| 79 year-old-man struck by a car in Fresno, California |

On January 16, 2009, a seventy-nine year-old-man was struck by a car. Apparently, while attempting to cross the street around 2800 David Avenue in Fresno, California, the man was struck by a car and involved in an auto accident near the Country Club Gate Shopping Center.
There is little to no information as to how quickly the driver was traveling or the lighting conditions that may have contributed to the car accident. On January 11, 2009 a teenage boy from Visalia, California was driving his 1992 Acura eastbound on Nares Avenue when he drove onto the dirt shoulder. Upon losing control of the vehicle, the passenger door squarely struck a large tree.

| Drowning at Fresno Motel |

Shortly after midnight on January 8, 2009, a guest notified the Days Inn staff on Jensen and Second Ave that a man appeared dead in the motel's jacuzzi.
When the man was removed from the jacuzzi, he was unconscious and not breathing. Fresno emergency personnel attempted to revive the unconscious man. The man was then transported to the hospital. As the man never regained consciousness, he later died at the Fresno hospital.
Witnesses did not observe anyone else in the pool area with the now deceased man. Security video tapes and witnesses will be reviewed in an attempt to determine the duration the man was in the jacuzzi both conscious and unconscious.

University of Oklahoma (OU) student declared brain dead following Snowboarding accident at Breckenridge Ski Resort in Colorado.
William "Billy" Khourie III, an Elk City, Colorado native died last night after crashing into a wood post at the bottom of Frosty's Trail at Breckenridge Ski Resort in Colorado. While a representative from the Swedish Medical Center in Englewood, Colorado declared the OU student deceased as of last night, the Colorado coroner rebutted that he was not clinically dead. Despite this disagreement, the 22-year-old's organs will be collected for transplant today.
It has been determined that the snowboarding accident resulting in the head injury was a direct result of his failure to wear safety equipment, specifically a protective snowboarding helmet. Thus, his brain was not protected during his snowboarding accident into a wood post at the bottom of Frosty's Trail at Breckenridge Ski Resort. Although the student was rushed by ambulence and emergency personnel to the Swedish Medical Center in Englewood, Colorado, he had already suffered irreparable head trauma.
This is a further example of the necessity to wear optional protective gear when involved in any type of physical activity, one should always wear a helmet or the appropriate protective gear (seatbelts, etc.) in case you are involved in a motorcycle accident, car accident, truck accident, or ATV accident to minimize brain injury or brain trauma. | Analysis of Passenger Vehicle Occupant Fatalities |

The National Highway Traffic Safety Administration has published an interesting study which documents fatalities for restrained and unrestrained passenger vehicle occupants for the State of California. While the overall trend is slightly decreasing, and interesting fact is that there are more restrained passengers (those wearing seat belts) which were fatalities than those which were unrestrained (not wearing seat belts).
In 2003, 1,451 restrained passenger vehicle occupants were fatalities while during the same period only 1,033 unrestrained fatalities occurred. As of 2007, 1,495 fatalities occurred to vehicle passengers who were wearing seat belts while 857 fatalities occurred to those individuals who were not wearing seat belts or other safety equipment.
These statistics may be somewhat misleading, in that they indicate that more fatalities occur to those individuals who wear seat belts rather than those who do not use seat belts. It has been shown, that wearing a seat belt and employing other safety equipment can significantly reduce injuries if you are involved in a car accident including aiding in minimizing brain damage or brain trauma.
So why then are there more fatalities for those who wear seatbelts?
One factor that is listed in the report is there are 453 to 243 fatalities in which the California police were unable to determine whether the individual involved in the fatality was wearing or not wearing safety equipment, such as a seat belt. But still, even if all of the undetermined fatalities were not wearing their seat belts, the numbers are still very close for those who were restrained and those were not restrained. So there must be another factor other than being restrained. Two possible solutions are that some individuals who are restrained may drive in a negligent manner thinking that they could never be injured if they are wearing a seat belt. Another reason is that innocent individuals may be struck by negligent drivers prematurely ending their life. Typically, those sober drivers are the ones who suffer more brain damage or brain injury than the impaired drivers.

The Fresno Police Department started a program to combat drunk and impaired drivers to reduce the number of fatalities resulting from car accidents involving these impaired drivers.
Fresno, California has an area of 101 square miles which is located in California's San Joaquin Valley. With a population quickly approaching a half-million people, Fresno is the fifth largest city in California. Starting in 2002, the Chief of the Fresno Police Department was alarmed with a sudden spike in fatal motor vehicle crashes jumped from a five-year average of 33 to 52. Of those 52, there were also six alcohol related fatal crashes, more than double the prior five-year average.
Since the early 1970s, Fresno, California received no revenue from traffic citations. Instead, most of the revenue from citation fines went to the State of California, with very little partioned off to the various counties. In 2003, this agreement was modified wherein the County of Fresno continued to receive its revenue stream, but money in excess of this amount written by the Fresno Police Department would be paid to the City of Fresno for increased traffic enforcement operations. After increasing Fresno's police force traffic unit from 24 to 44 resulted in more than 62,000 citations, more than two times those issued in the previous year.
With these efforts of the Fresno Police Department, as well as DUI checkpoints and enforcement of seat belt laws, total reported crashes in Fresno, California from 2002 to 2003 reduced by 10.5% from 4,420 to 3,955 according to the National Highway Traffic Safety Administration. Total injury and fatal crashes also decreased from 1,772 to 1,640, a reduction of 7.4%. Fatal crashes, also decreased from 52 to 46, a substantial decrease showing that the Fresno police's efforts were successful by 11.5%. As for alcohol-related injuries and fatal crashes, they were also reduced 17.4% and 50%, respectively.
