  Drunk Driver Crashes - Injures Pregnant Teen and Passenger

On Monday, March 23, 2009, not too far from Fresno, California, a man with multiple DUI charges was running from the police in a high speed car chase, ran a red light, and crashed into another automobile. The negligent, drunk driver was Otis Lee Taylor Jr. and he attempted to flee the scene after the car accident happened. The California Highway Patrol (CHP) reported that Taylor crashed into a car with two passengers who were young women; one pregnant 17- year old, and the other a 21 year old. The CHP chased and arrested Taylor as he tried to leave the scene of the accident.

Both victims of the car accident suffered injuries. The pregnant woman had moderate injuries and the 21-year old woman had serious injuries and was probably rushed to a local hospital where she may have been treated for deep cuts and bruises, or lacerations caused by the seat belt. She may have also suffered critical brain injuries or brain trauma and been in danger of losing her ability to walk or properly function.

The DUI offender, who was driving reckless and caused the car accident, is now awaiting trial where he is being charged with several felony accounts. He will face felony D.U.I., a felony hit and run, and finally a charge for driving with a suspended license. This negligent driver could have killed both of the passengers in the other car, not to mention an unborn child. Thankfully, he did not kill anyone, but he seriously injured them.   Truck and Tractor-Trailer Collide with a Van in a large motor vehicle accident

Early this morning, a truck and tractor-trailer collided with a van in a three-vehicle accident.  The California Highway Patrol reproted that paramedics and emergency personnel treated all of the seriously injured motorists at or near James Road and Central Avenue, north of Tranquility, California.

Major injuries were reported, which included brain injuries and brain trauma - including excessive bleeding.  There have been no further reports as to the stability of those parties involved in this multi-vehicle accident, but no fatalities have yet been reported.

  Motorcycle Accident Fatalities in California Steadily Increasing

Since 2003, the number of California helmeted motorcycle fatalities has been steadily increasing as reported by the National Highway Traffic Safety Administration.  In 2003, 322 fatalities were recorded, followed by 360, 401, 430 and 439 for the years 2004-2007 in all of California.  There much fewer motorcyclists fatalities who were involved in motorcycle accidents while not wearing Department of Transportation approved helmets.  For the years 2003-2007, the fatalities for non-helmeted motorcycle riders were 54, 59, 56, 67 and 68, respectively.

As the State of California has a law which requires all motorcycle riders to wear helmets - all of the motorcyclists who were fatally injured while not wearing their helmets were doing so in direct conflict with the California State laws.  While wearing a helmet can sometimes be burdensome, its benefits far outweigh any detriments that a motorcycle rider may attempt to come up with.  Especially, where life-ending brain injury can occur at speeds as low as 5 mph, it is essential to wear a helmet while traveling at even moderate speeds of 15, 25 or 35 miles per hour.

  Highway 99 Construction Fatality

A California Construction worker was killed last Wednesday morning. He was on the job when he was seriously injured after being run over by a tractor while working on Highway 99 near Fresno, California. The man was taken by helicopter to Modesto hospital where he died later that day as the result of his injuries from the accident. The victim was injured by a grading tractor and this particular tractor would have caused severe lacerations and even severed limbs. He may have suffered from significant blood loss and possible brain damage if he would have lived.

Although the details as to why he was hit by the tractor, or who was driving the tractor have not been released, the family of this man may have cause to file a workers compensation case against the company for whom the man worked given the fact that he was injured on the job.   Man and Infant Killed by Drunk Driver

Around 2:00 a.m. on February 2, 2009, a pick-up truck began driving the wrong direction on Highway 99.  The suspect's pick-up truck struck a Jeep carrying a man and an infant who were traveling southbound on Highway 99 near Earlimart.

The California Highway Patrol arrested the suspect at the scene of the fatal car crash accident.  The suspect now faces felony DUI and felony vehicular manslaughter charges.  The suspect was most likely driving while intoxicated under some substance to be driving the wrong way on the highway.

The accident is still under investigation, and the identities of both the male and infant occupant victims of the Jeep have not yet been released.  There is no initial indication as to whether the infant was in a child seat, booster seat, seat belt, or other safety equipment.

  Elderly Man Killed in Fresno Auto Accident

On the morning of January 25, 2009, a deadly crash at Belmont and Trimmer Springs in Fresno County, California, took the life of an elderly man.  According to the California Highway Patrol, Paul Bazar, 78 years-old, died when his car crashed into a tree.

The car crash investigators determined that he lost control of his car.  Upon losing control of his vehicle, his vehicle proceeded to travel off of the roadway, at which point his car struck a tree on the side of the roadway.

  Fatal Accident in Fresno County

On January 24, 2009, around 7:00 p.m., a hit-and-run accident claimed the life of 21-year-old Marcela Ramirez Vasquez at the intersection of Adams and Fruit, in Fresno, California.  This fatal car accident occurred when another driver failed to stop and ran through a stop sign hitting the victim's van. 

Specifically, Ms. Vasquez was a passenger traveling in a van with five other family members when the van was struck by Hector Manzo, which caused the van Ms. Vasquez was in to roll-over which ultimately took her life.

Initially, Hector Manzo fled from the Fresno fatal car accident scene, elevating potential charges to a hit-and-run.  Mr. Manzo was caught shortly thereafter by officials.  Mr. Manzo and his two passengers were all arrested.  Mr. Manzo was expected to be charged with manslaughter and Felony DUI charges.  The California Highway Patrol expected to book Mr. Manzo once he was treated for his head injuries at a local Fresno hospital.

  6 year old boy killed at Monster Truck Show

On January 16, 2009, a large metal piece detached from a monster truck doing doughnuts during the Monster Jam Monster Truck Show in the Tacoma Dome in Tacoma, Washington.  The monster truck is named "Natural High."

Shortly after this tragic accident that killed the six-year old boy and injured another spectator, Tacoma Police and Investigators begin examining pieces of the Monster Truck drive-train to determine how such an accident could occur.  The second injured spectator was rushed to the local hospital and maintains a stable condition.

The deceased boy's father told the local News Tribune of Tacoma, that his son and other relatives were in the stands no further than 25 feet above the arena floor.  The father further estimated that the piece of metal which detached and hurled towards his son was a metal ring weighing approximately seven to twelve pounds.

The tragic nature of this incident, especially with the more than 20 years of hosting the Monster Truck shows at the Tacoma Dome, indicate that no one can predict if and when they may be injured.  Especially when a wrongful death clearly occurs with such negligence on the part of the mechanics and the host of the Monster Truck event.

  $16,000,000 Medical Malpractice Jury Verdict

After a nine week trial in which Sharp Mary Birch Hospital and two of its doctors were accused of medical malpractice, wrongful death as well as intentional fraud in concealing real facts, a jury verdict was awarded for $16 Million dollars.

The jury deliberated for less than a day following the 9 week trial.  Along with awarding money damages, the jury further found that both the hospital and the doctors failed to care for their patient, 35, now deceased, and her unborn baby.

The facts leading up to this tragic incident were that the patient arrived at Sharp Mary Birch Hospital for a scheduled inducement of her pregnancy after a problem was determined with her amniotic fluid, the nourishing and protectve liquid surrounding an unborn child.  Specifically, during delivery, the baby boy became lodged in the birth canal with the umbilical cord wrapped around his neck, cutting off oxygen flow.  The baby boy tragically died because the doctors failed to provide proper medical care during the inducement procedure.  Things for both the hospital and the doctors were further exacerbated when the doctors attempted to protect themselves by making false statements to the parents as to the cause of death as well as falsifying medical records.  Defendants have stated their intention to appeal the awards which they believe is excessive.

  Girl Pedestrian Accident - Hit By Car in Fresno

On February 4, 2009, a fifteen-year-old girl pedestrian was involved in a pedestrian accident with a car in which she was hit by a car.  The young girl was within the crosswalk on Blackstone Avenue at Weldon Avenue when he was involved in the pedestrian-car-auto-accident where the car failed to stop and give her the right-of-way.

The young girl suffered moderate injuries including cuts to her head as well as injuries to her right hand.  Because of the injuries to her head, she may have either struck her head on the car or on the pavement.  Any time anyone hits their head, no matter how easily or softly, brain injuries, blunt force trauma, and brain trauma can occur which may impact that person's life, for which they should be compensated.  Brain injuries can result in the person being unable to ever smell again or it may limit motor skills, such as lifting one's head, rolling over, sitting up, balancing, crawling, and walking.  There are also may other forms and types of motor skill dysfunction which could result from a pedestrian accident.

  Motorcycle Rider Dies After Drifting Over Double-Yellow-Lines

On February 2, 2009, two motorcyle riders were out riding side by side Highway 88, just East of Tabeaud Road.  Both motorcycle riders were riding westbound on Highway 88.  According to the California Highway Patrol, both motorcycles drifted over the double-yellow-lines into oncoming traffic traveling eastbound.

The driver of a 2002 Toyota Sienna Van veered to the right in an attempt to avoid both motorcycle riders.  One of the motorcycle riders was grazed by the van and was knocked off his motorcycle and skidded along the ground.  His passengerless motorcycle continued driving on for a couple hundred feet prior coming to rest.  The other motorcycle rider was hit in a head-on collision with the van.  This motorcycle accident was fatal for this motorcycle rider who died from his critical injuries as a direct result of this motorcycle accident.  The other motorcycle rider involved in the motorcycle accident was transported to Sutter Amador Hospital in Jackson with serious injuries, including a broken left ankle and a sprained left wrist.  The driver of the van was not physically harmed.
