How a Child-Seat Can Prevent / Reduce Injuries in Auto Accident
Posted By Fresno Accident Attorney

The National Highway Trafic Safety Administration has estimated that over 7,500 lives have been saved through the use of child restrains and child-seats over the last 20 years.

California law reqiures children under 6 and / or weigh less 60 pounds (lbs.) are required to ride in a child-seat or in a child booster-seat.  While California has this requirement, some parents may not know the proper way to safely secure their child in the unlikely event they are involved in a car accident with either a motorcycle, truck, big-rig, or tractor-trailer semi-truck.

The California Highway Patrol has elected to hold a workshop to teach parents how to properly secure their child in a car-seat or booster-seat.  This workshop is aimed at parents and care-givers who may be transporting children in car-seats or booster-seats.  One of the major goals of this workshop program is to educate parents and care-givers about the necessity of car-seats and how car-seats can reduce the severe injuries which could ultimately be sustained by young children who are invovled in an auto accident.

The California Highway Patrol is also hoping to be able to examine currently owned car-seats to make sure that they are properly secured and they do not contain any product defects.  While this workshop program is not an intensive program, parents and care-givers must also take the responsiblity to routinely examine their child's car-seats to make sure that they are always securly fastened and all of the restraints are working properly.  Waiting until an auto accident occurs is the last time you want to check to make sure that this safetly equipment is working properly.

If a child or young adult has been injured in an auto accident in Fresno or where the car-seat failed to work properly because of a product defect in Fresno, please contact one of our Fresno Auto Accident Attorneys or one of our Fresno Product Defect Attorneys for a free confidential initial consultation to discuss the circumstances of your case immediately.

Drunk Driver Crashes - Injures Pregnant Teen and Passenger
Posted By Kellie Healey

On Monday, March 23, 2009, not too far from Fresno, California, a man with multiple DUI charges was running from the police in a high speed car chase, ran a red light, and crashed into another automobile. The negligent, drunk driver was Otis Lee Taylor Jr. and he attempted to flee the scene after the car accident happened. The California Highway Patrol (CHP) reported that Taylor crashed into a car with two passengers who were young women; one pregnant 17- year old, and the other a 21 year old. The CHP chased and arrested Taylor as he tried to leave the scene of the accident.

Both victims of the car accident suffered injuries. The pregnant woman had moderate injuries and the 21-year old woman had serious injuries and was probably rushed to a local hospital where she may have been treated for deep cuts and bruises, or lacerations caused by the seat belt. She may have also suffered critical brain injuries or brain trauma and been in danger of losing her ability to walk or properly function.

The DUI offender, who was driving reckless and caused the car accident, is now awaiting trial where he is being charged with several felony accounts. He will face felony D.U.I., a felony hit and run, and finally a charge for driving with a suspended license. This negligent driver could have killed both of the passengers in the other car, not to mention an unborn child. Thankfully, he did not kill anyone, but he seriously injured them. Someone needs to prevent him from ever having the chance to do something like this again.

There are local Fresno Automobile Accident Lawyers who are trained and well equipped to fight for the rights of those who were in this car crash and any other Fresno residents who have been involved in a car crash caused by a drunk driver or negligence on the part of another driver.   Fresno Teens May Not Drive Other Teens
Posted By Fresno Accident Attorney

A California law passed in 2006 prohibits newly licensed California teens from driving other minors (other than family members) without a supervising licensed driver who is at least 25 years old also in the vehicle.

Fresno police acknoweldge that a law such as this is very difficult to enforce.  The teens who are violating this California statute believe that the law is impractical with their various of after-school activities, as well as driving themselves to and from school every day.  The parents of the teens who are wilfully violating this California often are aware of this law, but would much rather no longer be their teenagers taxi or personal driver.

A recent study by the Insurance Institute for Highway Safety found that of the various teens interviewed, approximately half of the teens admitted violating this 2006 California Law.  California also has laws in place in which California teens may not drive between 11 p.m. and 5 a.m.

Despite teens and parents not agreeing with this law, reports have come out that show that these laws have in fact saved lives.  Unfortunately, there are still tragic incidents in which teen drivers fail to obey these rules and ultimately kill their fellow teen passengers.  Parents need to take a stronger stance and enforce these rules which are in place to save their children, as well as the children of others.

If you or a loved one has been injured by a teen failing to obey this law or any other law which ultimately resulted in a car accident in Fresno, please contact our Fresno Car Accident Attorneys immediately for a free evaluation of your case.

Cell Phone Laws for Commercial Motor Vehicle Drivers in Fresno
Posted By Fresno Accident Lawyer

Less than a year ago California passed new cell phone laws that prohibited drivers from using their cell phones while driving with the exception of a handless ear piece. These new cell phone laws target all motor-vehicle drivers, including commercial motor truck drivers. It is not uncommon to see a truck driver in Fresno talking on their phone, or on their two-way radio. Under the new laws, the only exception to the use of this kind of technology is in an emergency situation.

Commercial motor vehicles include tractor trailers, school buses, farm vehicles, and even tow trucks. These kinds of vehicles are large in size and are a challenge to operate even without the use of a cell phone. If a semi truck driver in Fresno, California is holding their cell phone while operating their commercial vehicle they are at risk of causing a trucking accident. It only takes a split second without a hand on the wheel for a truck to lose control and crash.

The exceptions for emergency situations allowing the use of a cell phone or a two-way radio by truck drivers are usually the kind of emergency trucking accidents which are caused by the illegal use of the cell phone in the first place. Trucking accidents cause deaths everyday on Fresno highways and one can only hope that the new cell phones restrictions aid in the prevention of trucking accidents.

If you have ever been the victim of a trucking accident in Fresno caused by a distracted truck driver on their cell phone you have cause to file a Fresno Personal Injury Lawsuit. When someone is seriously injured in a trucking accident it is an emergency. Consulting a Fresno Truck Accident Lawyer is in your best interest and will ensure that you get the most qualified legal representation available.

Fatal SUV Rollover on I-5 in California
Posted By Fresno Accident Lawyer

The California Highway Patrol (CHP) reported on Monday, April 13, 2009 that one person was killed in a single-vehicle accident on Interstate 5 not to far from Fresno, California the accident involved a SUV that rolled over causing the death of the automobile driver. The victim of this auto accident was pronounced dead at the scene of the accident. There are no reports concerning the cause of the SUV accident, but it was reported that there were animals being transported in the sports-utility vehicle and Animal control responded to the scene of the accident according to a CHP officer.

Roll-overs are a risk for anyone who operates a sports-utility vehicle (SUV) in Fresno, California. In research done concerning the degree of the risk of rollovers for SUVs a study found that motor vehicle safety is being sacrificed for the appeal of the eye. Those who are manufacturing sports-utility vehicles are putting every person at risk that drives off of the dealership lot when the company fails to follow proper protocol in manufacturing a safe automobile for both a driver and their passenger; even if those passengers are animals.

If the SUV is found to have had faulty mechanics then the family of the victim has   the legal right to file a wrongful death suit against the manufacturing company of that particular vehicle. It is a very sad thing when someone dies in an accident that may have been prevented had there not been negligence by an automobile manufacturing company. Serious injuries are caused by rollovers if it is not a fatal auto accident. The California SUV driver in this story may have suffered blunt force trauma causing serious head injuries which resulted in their death, or the driver may have suffered internal organ damage causing a heart attack, or other fatal injuries.

If you or your loved one has been involved in an SUV rollover accident on a freeway near Fresno, California caused by the negligence of a sports-utility vehicle manufacturing company you are the victim of a personal injury and may have grounds to file a California personal injury lawsuit. If you know anyone who has died in a SUV rollover accident in Fresno they may have died a wrongful death and you should contact a Fresno Auto Accident Wrongful Death Lawyer today. We are highly educated in the area of wrongful death claims, as well as auto accident injury claims and we will make all of the communications needed to have you awarded the rightful compensation for your pain and suffering.

Two Teens Killed in Auto Accident Near Highway 99
Posted By Fresno Accident Lawyer

A recent study reported by the National Highway Traffic Safety Administration found that, in the United States, reckless driving is one of the leading causes of death amongst teenagers between 16-19 years of age. On Tuesday, March 10, 2009 a fatal car accident left two local high school students dead, and one critically injured in Chowchilla, CA near highway 99. The accident involved a pick-up truck with three teenage passengers which collided with a Pacific Gas & Electric utility truck with only one passenger.

Although the cause of the crash has not been determined, it is likely that there was negligence on the part of one of the drivers, who may have ran a stop sign at the intersection of Avenue 23 ½ and Road 9. At any rate, the utility truck was carrying flammable materials which resulted in the pick-up truck's bursting into flames.  It has not been reported to have been alcohol or drug related, but a possible charge of Vehicular Manslaughter could be filed.

Both the driver, and one of the passengers were killed in the fire, the driver of the PG & E truck suffered only minor injuries and the third passenger was air lifted to a local Medical Center in Fresno.  It was reported that the surviving passenger had 4th degree burns covering 50- 60% of his body.

Injuries caused by auto accidents, especially burn injuries from collisions causing truck fires, explosions, and engine fires require immediate, long lasting and state of the art medical attention. This kind of medical attention may not be covered by insurance companies and costs the families and the injured a lot of money. The last thing a family or injured person wants to think about is whether or not they can afford the care needed to help them in their time of crisis.

If ever this were to happen to you, it is in your best interest to be informed about your rights in this situation. If you, your child, or anyone that you know have been involved in or died as the result of an automobile accident caused by reckless driving in Fresno, please contact one of our Fresno Auto Accident Attorneys for a free consultation so that you may be informed.

Teenager failing to wear seat belt died from head injuries
Posted By Fresno Accident Attorney

Teenager who failed to wear a seat belt suffered a head injury and ultimately died at North Memorial Medical Center in Robbinsdale, Minnesota

A teenage driver was injured in a car accident in Kanabec County, Minneapolis, Minnesota on January 9, 2009 and ultimately died at North Memorial Medical Center on January 10, 2009.  The driver's car was broadsided by another vehicle around 10:30 p.m. at the intersection of Highway 107 and Highway 70.  When the two vehicles collided, the driver suffered head injuries arising directly from this car accident.  The Minnesota police determined that the now deceased driver wasn't wearing any safety equipment, and specifically he wasn't wearing a seat belt.

The other two people involved in the car accident in Minneapolis, Minnesota suffered head injuries as well as minor injuries, and they both survived.  It was further reported that the driver which broadsided the deceased driver was also not wearing a seat belt.

In all accidents, there are always various issues to consider in determining who is liable for injuries or fatalities.  Although the driver who was broadsided was not wearing a seat belt, this is merely one factor in this determination.  An investigator needs to further determine if a party entered the intersection when they weren't supposed to which directly resulted in the car accident and brain injury.

Because of these and various factors, if you are injured in an auto accident in Fresno, it is essential that you visit our website and retain an attorney, especially if a brain injury or fatality occurred.

Reducing the Number of Fresno Car Accidents
Posted By Fresno Car Accident Attorney

The National Highway Traffic Safety Administration at one time determined that Fresno, California ranked eighth statewide annually for motor vehicle accidents and collisions.  Specially, by years-end of 1999, 3,445 injuries and 50 fatalities occurred in Fresno City, CA.  Car and motorcycle crashes are responded to by the Fresno City Fire Department within Fresno city-limits who employ firefighters and certified emergency medical technicians.

As is a common problem, training and equipment are at the mercy of a city and state's budget.  Specifically, the emergency personnel in Fresno, CA did not have the appropriate extraction equipment needed to remove individuals involved in bicycle accidents, truck accidents, car accidents, or motorcycle accidents which occurred within the city-limits of Fresno, California.  The budget constraints further prevented the Fresno City from disseminating a safety awareness education program, specifically in the use of seat belts, baby car seats, and bicycle helmets to further educate individuals and directly result in the protection and reduction of injuries to children from traffic accidents.

Upon receiving a grant, the City of Fresno immediately created a Vehicle Extrication Program as well as further expanding the existing Fresno public education and awareness program to directly combat its concerns of unnecessary injuries to children involved in both motor vehicle accidents and bicycle crashes.  To further educate the citizens of Fresno, the Fresno Fire Department participated in over 50 safety events in 2000 where over 7,000 children, parents and teachers were further educated.  The Fresno Fire Department further donated over 250 bicycle helmets to children to immediately begin protecting the children of Fresno, CA.

It is essential that your city follow the affirmative steps of Fresno, California to ensure that your residents are kept safe and are assisted with the newest and best technology in the unlikely event that you are involved in a car accident.

Despite these vast improvements to assist individuals who are involved in car accidents or other motor vehicle accidents within Fresno, California - these accidents continue to occur.  A professional and knowledgable Fresno motor vehicle accident lawyer should be hired if you were involved in any vehicle collision, especially if serious injuries, high medical costs, brain injuries or brain trauma resulted as a result of the negligence of another driver.

Super Bowl DUI Arrests in Fresno
Posted By Fresno Accident Attorney

On February 1, 2009, the Parlier Police Department set up D.U.I. checkpoints on Super Bowl Sunday.

All of the checkpoint locations were advertised in the local Fresno paper, but the officers still made five (5) DUI arrests, most of the drivers were well above the legal limit.  Last year, there were only three (3) D.U.I. arrests.

Each of this years DUI arrests had a Blood-Alcohol-Content (B.A.C. or BAC) or .11 or higher.  To be legally drunk in Fresno, California - a driver need only have a .08 BAC.  The highest BAC that the Fresno police tested was a .21, which indicates that this driver was having a lot of hard alcohol and was having much of it.

Despite these five (5) arrests in Fresno, there were still many auto and motor-vehicle accidents in and around Fresno as a direct result of other drivers who were not stopped and arrested at these DUI checkpoints.

If you or a loved one was involved in a Fresno Auto Accident as a result of the negligent drinking of another driver, please contact one of our experienced Fresno Auto Accident Lawyers who can assist you in receiving compensation for your injuries.
