  California Officers Cleared of Wrongful Death Claims

Reports came back yesterday that two police officers were clear of wrongful death charges made against them after they were put on administrative leave for the shooting of a mentally disabled woman last July upon their response to an emergency call made by her family. The news said that the officers believed that the woman was going after one of them with a knife or an ice pick; but it actually turned out to be a crochet needle. This story involved an extensive investigation and after much deliberation by a court, they were cleared of all charges.

The family of the woman who was shot in the back field wrongful death claims on grounds that they police officers did not have to actually kill their loved one. She was possibly having a seizure and was unaware of what she was doing as she lunged toward the officer. There were no reports given as to the actions taken by the California officers at the scene in an attempt to save her life, while preventing her from causing harm to herself or others.

This is a tragic case of what appears to be self-defense by California authorities. But, the victim's family would argue otherwise, and with reasonable cause. It is a sad thing when someone is shot to death by police officers when the evidence appears to be that it could have been prevented.   Fatal SUV Rollover on I-5 in California

The California Highway Patrol (CHP) reported on Monday, April 13, 2009 that one person was killed in a single-vehicle accident on Interstate 5 not to far from Fresno, California the accident involved a SUV that rolled over causing the death of the automobile driver.   Deputy Killed in Motorcycle Accident

On Thursday April 2, 2009 it was reported that a California correctional deputy from Porterville has died in a motorcycle accident on a local freeway last night on his way to meet his family for dinner not to far from Fresno. His motorcycle was hit by a car and he was air lifted to the Fresno hospital where he later died. There are no details concerning the other driver, and it is assumed that they were not injured. The accident is still being investigated but it appears that the car who struck the deputy is at fault. More details will be revealed as the pending investigation finds more information concerning the cause of the accident.

It is probable that the deputy was thrown from his motorcycle and onto the road or into traffic.   Fresno Medical Burn Center Treats Explosion Victims

Two California men were hospitalized on Tuesday after a gas explosion severely injuree them on the job. They were attempting to loosen a bolt on a tank full of combustible fluids when the explosion happened. Each man suffered serious burns, and it was reported that both men suffered third-degree burns one 30% of his body burned and the other 50 %.  Both men are considered to be in critical condition and were rushed to Community Regional Medical Center in Fresno, California for treatment at the burn center there.

All of the details of the workplace accident have not been determined, but the Division of Occupational Safety and Health (DOSH) are investigating the facts of the case. In total close to 18 firefighter responded to the emergency call and none were reported to have experienced any injuries. According to a worker at the plant it is not clear as to why the men were using fire torch on a fuel tank, because it is not a normal procedure or practice of the plant to do so.
This may very well be a case of workers negligence to properly operate machinery on the job, but it also may be a manufacturing malfunction on the fuel tank. Maybe this could have been prevented by the company not making a blow torch so easily accessible to works as an option of loosen bolts. The Fresno Police Department (FPD) has been blamed for the death of another man. Fresno Police officers fired 35 rounds at a man in the Stoney Brook apartment complex on Sunday March 29, 2009.   Fresno Police Department Hosts Memorial DUI Check Point

On Friday night, March 27, 2009 the Fresno County Police Department (FPD)  held a memorial DUI checkpoint in remembrance of an automobile accident in 2007 where a man who was struck by a car operated by a drunk driver. The checkpoint was stationed between Tulare and Chestnut in Fresno, CA. The D.U.I. check station was successful in preventing seven potential car accidents that would have been caused by 7 different drunk drivers that were on the road that night.

In the 2007, Jesse Velez Junior was killed after a drunk driver ran a stop sign and crashed into the van that Jesse was driving.  He was a son, a husband and a father who is greatly missed by his family who will never forget this tragic event.   Fresno Nursing Home Fined for Negligence

In Fresno, California a popular nursing home, the Raintree Convalescent Hospital, has been fined $80,000.00 for nursing home negligence which resulted in the wrongful death of one of their patients. The Fresno man, who was reported to be a schizophrenic, choked on his food as the result of negligent supervision by the nursing home staff.  The staff was more than aware that the patient had trouble chewing his food and was at risk of choking unless his food was properly cut or chopped into small pieces. The nurses tried to perform the Heimlich maneuver but were unable to remove the food lodged in the man's throat and the paramedics attempted to remove the meatball by suction, but were unsuccessful. The man died later that night in the Fresno hospital.

The California Department of Public Health (CDPH) conducted an investigation into the hospital and found that because the home was informed of the choking hazard posed to the man if he were to eat whole portions of food, the nursing home should be held accountable in his death and fined for their actions. In addition to the fines, the nursing home has gone down on the legal rating scale for nursing homes. The home is now a one out of five stars on the rating scale and probably at risk of a wrongful death claim against them by the family of the patient who choked to death.
